Appeals court upholds West Virginia ban on abortion medication

CHARLESTON, W.Va. (WOWK) — The Fourth Circuit Court of Appeals has ruled in favor of West Virginia’s abortion ban that limits access to an abortion drug called mifepristone.

GenBioPro, the makers of the abortion medication, argued that the Food and Drug Administration (FDA) Amendments Act of 2007 preempted the state’s law. The Fourth Circuit Court of Appeals in Richmond rejected this argument.

West Virginia Governor Patrick Morrisey was attorney general when the lawsuit was filed. He praised the ruling on Tuesday morning.

“Big win out of the 4th Circuit today,” said Morrisey. “I defended this law as Attorney General and am proud to see a victory in this case. West Virginia can continue to enforce our pro-life laws and lead the nation in our efforts to protect life. We will always be a pro-life state!”
