
The decision was co-signed by three judges. It pauses all lower court matters related to the case pending the resolution of the appeal.
Hutson was facing up to $500 in fines and up to six months in jail.
The sheriff was found to be in contempt of court for not following a court-mandated order to transport inmates on weekends and holidays.
“I think the problem the sheriff has is there’s legal reasons and there’s practical reasons, and whether or not the Fourth Circuit Court of Appeals will agree with the practical reasons of why she didn’t do what she was supposed to do by the lower court is a different question,” said legal analyst Justin Schmidt.
The date for the appellate court’s ruling has not been released. WGNO reached out to Hutson regarding the case’s suspension and has not heard back yet.
