Foster pleads in assault cases; sentenced to prison


Justin Robert Foster who was facing a number of charges in criminal cases stemming from allegedly violent assaults on family members and others appeared in Baxter County Circuit Court/Criminal Division Monday, November 3.
Foster pled guilty to the charges that remained active against him and was sentenced to six years in prison with three to serve and three suspended.




Charges filed against the 43-year-old Foster have included aggravated assault on a family or household member, domestic battery, violating protective orders, terroristic threatening and endangering the welfare of a minor.

The state dismissed two of his open criminal cases that were filed in 2023 as part of the plea agreement.

The charges stem mainly from both verbal and physical confrontations Foster has had with his estranged wife, teenage son and other family members as well as people outside the family.

WIFE FLEES, FOSTER FOLLOWS

In one of his active cases, Foster is charged with terroristic threatening, violating an order of protection and criminal mischief.

According to the probable cause affidavit the incident took place on October 22 last year. His wife had reportedly fled from her home along Millcreek Lane in Norfork because she said she was afraid Foster was “going to hurt her.”

She went to another residence, but Foster soon showed up there and broke out windows in her 2011 Ford Fusion. He later threatened to kill the male residence of the home where his wife had taken refuge and to burn the house down.

ATTACKS WIFE AND SON

Foster was also reported to have assaulted both his wife and teenage son and threatened to kill police officers who might respond to the situation.

At one point, Foster is alleged to have been arguing with his wife when he began pulling her hair and chasing her around the property.

The wife said she had seen her estranged husband point a rifle at her and others.

The couple’s teenage son attempted to break the fight up and his father attacked him.

Foster is alleged to have begun “choking the son” and investigators reported the young man had red marks on his neck.

The son said that at one point his father chased him down Mill Creek making threats toward the younger man. Foster was reported to have been armed with knives.

According to the probable cause affidavit, when deputies arrived on scene, Foster was leaning against a pickup truck and said he felt as if he was having a heart attack.

A Baxter Health ambulance arrived to take Foster in for treatment. Because of the violence involved in the incident, the ambulance crew requested a deputy ride with them.
