These mark the latest developments in the President Trump’s plans to deploy federal troops in some cities, including Portland and Memphis.
But Oregon is still waiting for the ruling from the 9th
As of right now, National Guard troops can remain under federal control, but cannot be deployed as the appeals process continues to play out on the temporary restraining order put in place by U.S. District Court Judge Karen Immergut.
Professor Tung Yin from Lewis and Clark Law School told KOIN 6 News he believes the appeal will favor the administration.
“If the troops are only deployed to protect the ICE building, my sense from the argument is that the panel would be probably OK with that,” he said.
As for the next steps and when the ruling will come down, Yin says the panel is likely drafting their opinions and looking to announce their ruling any time before Oct. 17.
That’s also when Judge Immergut has a hearing to potentially extend the temporary restraining order, which is what is currently blocking the deployment of the National Guard in Portland.
