Leaders plan to sue Trump Administration for deployment of California National Guard

(FOX40.COM) — Gov. Gavin Newsom stated on Sunday in an ‘X’ post that he plans to sue President Donald Trump for sending 300 California National Guard members to Oregon, despite a judge blocking his order.

“We are taking this fight back to court,” Newsom said in an ‘X’ post, after the Trump Administration continued deploying members of the California National Guard out of state to Portland, Oregon.

A federal court ordered that the Oregon National Guard be returned to state command after being deployed to the streets of Portland. The Trump Administration then sent the California National Guard in their place.

The U.S. District Judge Karin Immergut, who was appointed by President Trump, rejected the administration’s justification for deploying California guardsmen to Oregon.

“This historical tradition boils down to a simple proposition: this is a nation of Constitutional law, not martial law,” the judge said in his order. “Defendants have made a range of arguments that, if accepted, risk blurring the line between civil and military federal power — to the detriment of this nation.”

Despite the judge’s order, Newsom said that the 300 National Guardsmen are still “on their way there now.”

Oregon Attorney General Dan Rayfield also released a statement on ‘X’ explaining that he intends to keep the administration accountable and stressed that Portland is not a war zone.

Rayfield originally secured the court order to block the president’s order. Yet, the Trump administration continued to defy the temporary restraining order, according to officials.

In the statement, Rayfield also stated that the attorney’s office is “assessing our options and preparing to take legal action.”

Newsom said, “The Trump Administration is unapologetically attacking the rule of law itself and putting into action their dangerous words — ignoring court orders and treating judges, even those appointed by the President himself, as political opponents.”
