Throughout the trial, a total of ten witnesses testified with the prosecution counsel. Witnesses spoke about the process of pre-trial diversion, if they worked with Gary Haynes amd who were the people that presided over the program, which were Dusty Guidry and Gary Haynes.
During the trial, the last witness with the prosecution mentioned how Haynes was viewed as the First Assistant District Attorney, which historically speaking was the second person in charge. His office was next to the D.A. which was usually the first A.D.A office.
The defendant’s council argued Don Landry wanted the program and had discretion of who was let into the program and if anyone had issues with how the program was run why they didn’t go to the D.A.
