Court records state the Calico Rock City Council approved a bid from Summers’ business, Lights On Electric, on May 13, 2024, for two generators and related equipment at an estimated cost of $113,225. Two days later, the city issued a check to Summers for $87,500, which was deposited into his bank account in Batesville.
According to the affidavit, the account had a negative balance of $616.05 before the deposit. After the city’s check cleared, the account balance rose to $86,480.13 but quickly decreased. By the end of May 2024, the account balance was $6,764.90.
City officials made repeated attempts to obtain documentation of the order or a refund, the affidavit said. Summers requested extensions into 2025 but did not provide proof of purchase. In June 2025, he promised either tracking numbers or a refund by the end of that month, but neither was provided. The city later filed a complaint in circuit court, and in August, a settlement offer was made on behalf of Lights On Electric proposing installment payments.
On Aug. 19, 2025, Sheriff Charley Melton spoke briefly with Summers by phone and asked if he had documentation showing the generators were ordered. Summers said he did not, according to the affidavit. The call ended when the sheriff’s office lost power. Melton later attempted several follow-up calls, leaving voicemails, but did not receive a response.
The sheriff’s office obtained additional bank records through a subpoena showing Summers as the sole owner of the accounts tied to Lights On Electric.
Summers is free after posting $7,500 bond.
