Court documents show that on May 18, detectives found the body of James Dale Carmack, who had been shot multiple times. He was pronounced dead at the scene on Highway 1209.
Investigators wrote in an arrest report that as the investigation progressed, multiple witnesses and supporting evidence allegedly identified James “Sam” Bergman, 24, of Irvine, as a person of interest.
On Aug. 20, authorities met Berman at the 1000 block of Winchester Road, where he agreed to be taken to the Estill County Sheriff’s Office for an interview.
After being read his Miranda rights, Bergman allegedly confessed to investigators that he had shot and killed Carmack and further admitted to putting his body in a vehicle and driving to a swimming hole on Wagersville Road.
He allegedly gave the gun used to kill Carmack to an “acquaintance” of his to “dispose of it,” per court documents.
Bergman was arrested and charged with murder, tampering with physical evidence, and abuse of a corpse. He was lodged in the Three Forks Regional Jail on a $1 million cash bond.
The investigation into Carmack’s death remains ongoing.
