The ordinance defines what a smoke or vape shop is and what they sell. It also sets location limits. It was authored by council members Rowdy Gaudet, Denise Amoroso, Carolyn Coleman, and Twahna Harris.
Shops and their signs must be at least 500 feet away from:
- Schools.
- Churches.
- Libraries.
- Daycares.
- Parks.
- Other smoke or vape shops.
According to the ordinance, stores that don’t meet these rules can keep operating. However, they will be labeled “nonconforming” and must follow special development code rules.
The ordinance requires shops to display clear signs at all public entrances. These signs must state that minors are not allowed inside.
Violations may lead to fines of up to $500 for the first offense. For a second offense within a year, the fine increases to $1,000. A third offense or more within a year could result in a $1,500 fine. The Department of Development would be responsible for enforcing these rules.
