According to court documents, Houck’s sister, Rhonda McIlvoy, has asked for full custody of the 12-year-old, who was two when his mother went missing.
In a petition, the court noted that Ilvoy has had temporary custody of her nephew since 2023 and has provided him with “a stable and secure environment and good and proper care.”
Documents state that his “permanent custody be awarded to the Petitioner (McIlvoy) so that he may have permanency and stability.”
WDRB, the FOX affiliate in Louisville, claimed that in 2023, both of the 12-year-old’s grandmothers had previously fought for custody of him in court.
Houck, who was found guilty on July 8 of complicity to murder and tampering with physical evidence regarding the disappearance and presumed death of Rogers, is due to be sentenced on Aug. 21.
