Kentucky Fish and Wildlife said that game wardens were called to an area near the Marsh Branch Boat Ramp.
At the scene, wardens noted in an arrest citation that an individual had multiple injuries to the head from the boat’s propeller.
Don Peace, 53, and two other witnesses all confirmed he was driving the boat at the time of the accident, according to the citation. Officials noted a strong alcoholic smell was coming from all three of them. Peace was said to have bloodshot eyes as well and initially refused a field sobriety test.
Fish and Wildlife officials said he agreed to a breathalyzer after a few minutes, which confirmed he had been drinking alcohol.
Peace was arrested and charged with first-degree vehicular homicide while under the influence of alcohol and driving a boat while intoxicated.
Arrest records show he is being held in the Laurel County Correctional Center on a $100,000 cash bond and is scheduled for a hearing at 11 a.m. on July 29.
The investigation is still ongoing, and the name of the deceased has not been released by the Laurel County Coroner’s Office.
