Pritzker signs bill cracking down on squatters into law

ILLINOIS (WCIA) — Governor JB Pritzker signed a bill into law on Monday that makes it easier for law enforcement to remove squatters from a home — without going through the eviction process.

According to Pritzker’s office, Senate Bill 1563 will allow law enforcement to act sooner in squatter cases throughout the entire state. Before the bill was signed, Illinois law did not distinguish between tenants who had overstayed their lease and squatters if the squatter said that they are a tenant or an owner.

“This outdated eviction law has treated squatters the same as tenants, leaving property owners in limbo and tying the hands of law enforcement,” Pritzker said in a news release. “I want to thank the bill sponsors, Sen. Lakesia Collins and Rep. Jawaharial Williams, for their leadership in spearheading this important legislation. This bill delivers long-overdue clarity, closes dangerous legal loopholes, and ensures that trespassers can no longer manipulate the system to delay removal from properties they never had any right to occupy in the first place.” 

SB1563 also clarifies the difference between lawful tenants and unlawful squatters and ensures that property owners do not have to go to court to remove squatters. In addition, it outlines to law enforcement that when property owners show valid ownership, and when trespassing is “evident,” officers are able to remove trespassers.

Pritzker signed the bill on Monday and it will go into effect January 1, 2026.
