Pre-trial release denied for Elgin man accused of shooting at estranged wife during confrontation outside Naperville home

NAPERVILLE, Ill. — Pre-trial release has been denied for an Elgin man accused of shooting at his estranged wife during a confrontation that defied a protective order.

35-year-old Rocky Ahmedyar, an Elgin resident, is facing several charges, including one count of attempted first-degree murder, one count of aggravated discharge of a firearm, one count of aggravated stalking and one count of misdemeanor violation of an order of protection, DuPage County State’s Attorney Robert Berlin announced Wednesday.

Prosecutors say the charges stem from an incident that allegedly unfolded outside of a home in Naperville early Tuesday morning.

Prosecutors say the victim, Ahmedyar’s wife, who is already wrapped up in an active domestic violence case involving the suspect, has an order of protection against him out of Kane County.

The two previously lived together, but prosecutors say she moved out of the family home with their three children three months ago and was staying at a residence in Naperville at the time of the incident.

Prosecutors say it all unfolded around 3 a.m. Tuesday outside of a home in Naperville.

According to prosecutors, the victim was in a car outside the home preparing to leave for work when Ahmedyar allegedly approached the driver’s side of the car while armed with a gun.

Ahmedyar then allegedly told the victim that she had to talk to him, or he would shoot her.

Prosecutors said after the two spoke for about 30 minutes, a car drove by and Ahmedyar lowered his gun. But while the gun was lowered, the victim placed the car into reverse and began to reverse slowly.

As the victim continued backing up her vehicle, prosecutors said Ahmedyar walked alongside the car before he eventually held up the gun and demanded she stop the vehicle and listen to him.

According to prosecutors, Ahmedyar then fired a shot at the victim, missing her by just millimeters.

Following the shooting, Ahmedyar allegedly fled the scene on foot but was taken into custody less than an hour later as he pulled into his driveway in Elgin.

Further investigation revealed that in addition to the shooting, Ahmedyar had also allegedly sent the victim a multitude of harassing and threatening text messages.

Later that day, with the help of a K9 unit, DuPage County deputies recovered the gun allegedly used in the shooting.

“Domestic violence is not a private family matter, it is a serious crime that if left unchecked, can escalate causing serious physical harm to the victim, up to and including death,” Berlin said. “While the victim in this case was forced to endure an extremely stressful situation allegedly at the hands of her husband, we are all extremely thankful that she was physically unharmed. I thank the Naperville Police Department for their work on this case and for the quick apprehension of the defendant. I thank the West Chicago and Elgin Police Departments as well as the DuPage County Sheriff’s Office’s K-9 Unit for their assistance. I also thank Assistant State’s Attorneys Anna Derkacz and Helen Kapas for their efforts in securing strong charges against Mr. Ahmedyar.”

During a court appearance on Wednesday, Judge Joshua Dieden granted the State’s motion to deny pre-trial release for Ahmedyar.

Ahmedyar is set to return to court for arraignment on July 14.
