NEW ORLEANS (WGNO) — After undergoing a second mental evaluation, Judge Lance Affrick has ruled Daniel Callihan competent to stand trial.
Callihan is accused of killing Tangipahoa Parish mother Callie Brunett, and the kidnapping and murder of one of her two young daughters in 2023.
Callihan has been indicted on two counts of first-degree murder, one count of aggravated kidnapping and one count of second-degree kidnapping.
Callihan’s lawyer Kerry Cuccia agrees with the testimony that Callihan is competent as long as he is taking the correct medication.
“When you have someone who has a mental condition like Mr. Callahan, it is key to get the right dosage. It was clear that the dosage he has now is, if the increased dosage is the appropriate dosage. So just exactly what Doctor Dillon had seen earlier, the lower dosage was creating problems for competency. Those problems have been solved by the proper dosage of medication,” said Cuccia.
The judge has set the trial for July 28.
