Bloomington pays damage settlement after a man was jailed 5 days in a wrong arrest

The city of Bloomington reached a settlement on Tuesday after claims that its officers incorrectly identified and jailed a man in 2021.

The Minnesota Chapter of the American Civil Liberties Union (ACLU-MN) said the city agreed to settle a lawsuit over the wrongful arrest of Kylese Perryman. Bloomington agreed to pay Perryman monetary damages and change police training and policy.

As we previously reported, Bloomington police arrested Perryman after reviewing security video tied to a carjacking and robbery at the Mall of America and using stolen cards at a Walmart. ACLU said Perryman’s movements were verifiable and that tattoos, height and weight clearly set him apart from the suspect.

According to the settlement announcement, Bloomington police detained Perryman for five days before placing him on electronic home monitoring.

The lawsuit alleged that Bloomington and Hennepin County violated Perryman’s Fourth Amendment protection against false arrest and false imprisonment. The lawsuit also alleged that police failed to train and supervise law enforcement in identifying and arresting suspects.

As part of the settlement, Bloomington agreed to the following changes to its training and policy:

Adopting a procedure that incorporates the KOPS (Keeping Our Police Safe) alert guidelines contained in the BCA’s Minnesota Criminal Justice Information System Operating Manual. 

Adopting a procedure that states that police officers are prohibited from issuing KOPS alerts as arrest warrants. 

In 2021, Bloomington police issued a KOPS alert for Perry after identifying him as a suspect, leading to his arrest and booking into jail.
