PSP: American Legion post faces host of liquor law violations

FRACKVILLE – State liquor control officials are accusing a local American Legion post of nearly two dozen liquor law violations.

The Allentown District Enforcement Office of the Pennsylvania State Police Bureau of Liquor Control Enforcement announced the charges in a news release earlier this month.

They are lodged against the American Legion Home Association of Frackville, which operates the American Legion Post 398 on South Mahanoy Street.

Violations range between January 2024 and January 2026 and including accusations of failure “to adhere to constitution and/or by-laws; to fulfill charter purposes,” among others.

The association is accused of “improperly” admitting members, failing to hold regular meetings, and that the “organization was not operated for the mutual benefit of the entire membership.”

Authorities allege that between Jan. 1, 2024 and August 27, 2025, gambling was allowed on site, which is both an alleged liquor code violation and an alleged crimes code violation.

Additionally, on March 2 and Dec. 20, 2025, authorities allege that the post commander and vice president of the home association “consumed alcoholic beverages while tending bar.”

On March 2, 2025, the post is accused of failing to require patrons to vacate the bar at the required time, that patrons were able to remove alcoholic beverages from the bar after 3:30am, and that malt or brewed beverages were served between 3am and 7am that night as well.

Records violations are also alleged, along with an alleged failure to ensure a manager completed RAMP training.

The charges will be brought before an Administrative Law Judge who can impose fines or suspend or revoke the license.

The Pennsylvania Liquor Control Board shows the post’s license as being in safekeeping.

On Jan. 23, the post announced that the bar would “close temporarily to reorganize and get things where they need to be.”
