Contempt order dismissed after DOJ returns belongings to man released from ICE custody

    DOJ attorney’s contempt order dismissed 

A federal judge has dismissed a contempt order after the Department of Justice (DOJ) returned a passport to a man recently released from ICE custody.

Court records show a judge had granted petitioner Rigoberto Soto Jimenez’s release and the return of all of his belongings, including his identity documents, on Feb. 9 after the DOJ did not meet the court’s Feb. 5 deadline to respond to his habeas petition.

The conditions of the judge’s order had not been satisfied by Feb. 17, and she ordered a DOJ attorney to show cause as to why he should not be held in contempt.

During a Wednesday hearing on Feb. 18, the attorney was held in civil contempt and threatened with a $500-a-day fine until Soto Jimenez’s passport was returned.

Court filings show that the belongings were returned to Soto Jimenez on Thursday, Feb. 19, and the attorney will not be fined.
