The Indiana Supreme Court on Tuesday denied the City of Bloomington’s petition to transfer jurisdiction in the annexation dispute involving western land parcels designated as Areas 1A and 1B, leaving the Indiana Court of Appeals decision intact.
In a one-page order dated Feb. 10, 2026, the court said it reviewed the Court of Appeals decision, the record on appeal, briefs filed in the Court of Appeals, and materials submitted with the request to transfer before voting on the petition. The order states the court “DENIES the petition to transfer.” The order is signed by Chief Justice Loretta H. Rush and notes that all justices concur.
The case is captioned City of Bloomington, Monroe County, Indiana, et al. v. County Residents Against Annexation, Inc., et al. It lists Court of Appeals Case No. 24A-PL-01967 and Trial Court Case No. 53C06-2203-PL-509.
A denial of transfer means the Supreme Court will not take up the appeal, and the Court of Appeals ruling stands as the final appellate decision in the case.
Bloomington’s annexation plan originally included multiple areas. The petition denied Tuesday concerned Areas 1A and 1B, which have been the subject of years of litigation between the city and a remonstrators’ group, County Residents Against Annexation.
