Following their apprehension on Jan. 20, Liam Conejo Ramos and his father, Adrian Conejo Arias, were quickly transferred to a U.S. Immigration and Customs Enforcement processing facility in Dilley, Texas, about an hour from San Antonio.
U.S. District Judge Fred Biery on Monday ordered the federal government to keep them within the jurisdiction of the Western District of Texas while their legal case plays out.
A U.S. Department of Homeland Security spokesperson claimed Conejo Arias is an “illegal alien.” Immigration attorney Marc Prokosch pushed back on that claim, saying Conejo Arias has no criminal record, entered the country legally and declared his intent to seek asylum at the border.
