Missouri man facing multiple charges after fighting with law enforcement in Searcy County

A Missouri man is facing multiple charges after fighting with three law enforcement officers as they tried to arrest him while he was under the influence of narcotics, before two more arrived to help finally take him into custody. Facing seven charges, four of them felonies, is 46-year-old Christopher James Dale of Nixa.

According to the probable cause affidavit from the Searcy County Sheriff’s Office, two deputies, with the assistance from the Marshall Police Department, were called to a residence in the Oxley community for a man who was under the influence of narcotics and had become belligerent.

When the first two deputies arrived, they talked to the homeowner who said she tried to help Dale, but he became too aggressive, so she went outside.

The deputies went in the house and observed Dale rolling around on the living room floor naked, screaming and cussing and constantly twitching.

The deputies noticed on the coffee table a white powdery substance, a lottery ticket with a white crystal like rock substance and residue on it. It field tested positive for methamphetamine.

An ambulance crew arrived, but Dale would not comply as the attempted to treat him, so they said they would not be transporting him to the hospital.

At this point, the two deputies and the Marshall officer attempted to take Dale into custody. Dale had rolled into the bathroom and would not comply with commands. He cussed at the officers and tensed his body up. At one point, he kicked one of the deputies in the groin and struck another deputy in the face with his hand.

A deputy used his taser to dry stun Dale when he started kicking again, but it had no affect on him. They used six closed hand strikes to Dale’s face, but again, it had no affect on him. At that point, the three law enforcement officers decided to keep Dale on the ground until additional units arrived. It was noted in the affidavit “…due to the narcotics Christopher was under the influence (of) it seemed as if he had super strength or more strength than what he would have if not under the influence of narcotics.”

Two more deputies arrived shortly and the dragged Dale into the living room and took him into custody.

Dale is facing two counts of second degree battery on a law enforcement officer, possession of methamphetamine and possession of drug paraphernalia, all felonies, along with misdemeanor charges of resisting arrest, third degree assault and possession of schedule VI controlled substance. He is free after posting $5,000 bond.

PREVIOUS ARRESTS

Dale has three previous felony arrests in Missouri. His charges have included stealing, possession of a controlled substance, possession of drug paraphernalia.

All three cases are still open.
