
WEST VALLEY CITY, Utah (ABC4) — A man has been charged with aggravated kidnapping and rape in a case from 2024, where he allegedly assaulted the victim on multiple occasions while unlawfully detaining her.
Josue Francisco Orellana, 20, was arrested last week in connection with a rape case from 2024. He has since been charged with one count of rape, which is a 1st Degree Felony, and one count of aggravated kidnapping while committing unlawful detention, a third-degree felony.
Orellana was also charged with one count of aggravated assault, a third-degree felony, and four counts of assault, a Class A misdemeanor. All counts also have the domestic violence attribute.
He is scheduled to appear in court later this week for an initial appearance.
Case history
According to court documents, Orellana allegedly physically and assaulted the victim on multiple occasions, while unlawfully detaining her, between October 1, 2024, and November 8, 2024.
In August of 2025, the victim reported to law enforcement that in November 2024, she was engaged in consensual sexual activity with an individual who she knew as Josue Dybala, later identified as Orellana.
Reportedly, Orellana had become aggressive and refused to stop when the victim asked him to. He then allegedly raped her while holding the victim in place. He also reportedly told “her to keep begging” and continued despite her “pleas for him to stop”.
The victim also told law enforcement that Orellana had previously been aggressive and left bruises and bite marks on her body. He also allegedly grabbed the victim and choked her. She provided law enforcement with photographs of bruises that had been taken on October 24, November 4, and November 8, 2024.
The court documents also state that the victim confronted Orellana about the rape in January 2025 and he stated that “he thought it was role play”.
During a photo lineup, the victim was able to identify Josue Orellana. He was arrested and taken into custody on October 22, 2025.
