Docs: Indy man charged after having Delta-9 in blood at time of fatal crash

INDIANAPOLIS — An Indianapolis man has been charged in relation to a fatal crash on the southwest side of Indianapolis that occurred in mid-August.

According to court documents, Evan Palacios Mota has been charged in Marion County with:

  • One count of operating a motor vehicle without ever receiving a license – resulting in death or catastrophic injury, a Level 5 felony
  • Sponsored
  • Once count of operating a vehicle while intoxicated: prior conviction within seven years, a Level 6 felony
  • One count of operating a vehicle with a Schedule I or II controlled substance

On Aug. 17, officers with the Indianapolis Metropolitan Police Department were called to a reported crash near the intersection of Kentucky Avenue and South Lynhurst Drive.

According to previous reports, the driver of a white hatchback, later identified as Richard Perry, was pronounced dead on the scene. The driver of the other vehicle, a black pickup, was later identified as Palacios Mota.

At the scene, Palacios Mota reportedly told medics he was worried about drinking and smoking weed the night before. The court documents state that Palacios Mota reportedly had a problem keeping his eyes open, stating he was tired from the night before.

In a statement to officers, Palacios Mota said he was driving on Kentucky Avenue and was approaching the intersection with S. Lynhurst Drive. The white hatchback reportedly turned left in front of Palacios Mota’s truck and crashed into it.

According to data collected from Palacios Mota’s truck, the truck was reportedly traveling at 60 mph half a second before the crash. Palacios Mota also reportedly tested positive for both Delta-9 Carboxy THC and Delta-9 THC

Indiana’s public court reporting system indicates a warrant has been issued for Palacios Mota’s arrest.

Additional documents filed on Wednesday indicate Palacios Mota violated the terms of probation he was under during the Aug. 17 crash. He was convicted of operating a motor vehicle with an alcohol concentration equivalent to .15 or more last October.

Mota’s probation required him to refrain from committing a new criminal offense, and he failed to submit to a mandatory drug screening on Oct. 20.
