An ICE agent shot one of them for allegedly ramming an ICE vehicle.
It happened on Saturday on Chicago’s Southwest Side.
In the end, the judge said given both are us citizens, lifelong residents of Chicago with no criminal history, they can be released on bond, pending trial.
Marimar Martinez, 30, and Anthony Ruiz, 21, appeared at the detention hearing Monday.
Prosecutors called them a danger to the community.
Defense attorneys saying that’s far from the truth.
A federal complaint alleges both used their vehicles as dangerous weapons against federal agents.
This stems from an incident that happened on Saturday afternoon near 39th and Kedzie in the city’s Brighton Park neighborhood when federal border patrol agents, in a marked vehicle, say they were followed for miles by a convoy of civilian vehicles.
In the federal complaint, prosecutors allege Martinez and Ruiz used their vehicles to barricade and ultimately hit the agents’ SUV to block them in.
When the agents got out, prosecutors say Martinez drove her vehicle directly at one of them, prompting the officer to fire his gun. Martinez was hit and drove about a mile away where she was taken to a hospital for treatment. Ruiz was arrested nearby at a gas station.
Martinez’s attorney said there is a danger to the community, but it’s not his client and alleged agents were the ones to hit both vehicles.
He said that while his client legally had a gun with her, she never pulled it out. It remained in her purse.
Ruiz’s attorney said his client was caught up in a situation not of his making and alleged he was hit by the agent’s vehicle, not the other way around,
Federal judge Heather McShain disagreed with prosecutors and said the defendants, who don’t have a criminal history, should be able to be free on bond before their trial, specifically citing Martinez’s gunshot wounds—so she can get proper medical care.
The charges they both face have a maximum penalty of 20 years in prison and a $250,00 dollar fine.
