'It's just art' A Halloween decoration raises eyebrows, but HPD says it's legal
“This is just a little display on my own private property,” said homeowner Mark Rodriguez.
The unusual setup has sparked curiosity and some concern among social media users and people driving past. One driver told CW39 off camera that it was a bit much but needed to be said.
The homeowner behind the display said it’s his form of art and not meant to scare people, but rather about expression. “This year, I just thought this would be appropriate for where our country is going. I mean, my community lives in fear,” said Rodriguez.
The display has grabbed the attention of thousands who don’t like it, and it comes as mass deportations strike fear across Houston.
Rodriguez said the display is supposed to show how his community is feeling under the pressure.
CW39 reached out to Houston police, who confirmed they’ve received just one complaint about the display. HPD also said Rodriguez isn’t breaking any laws. Under Texas law, residents are allowed to express themselves with displays on their property as long as it’s not threatening or obscene.
Civil rights attorney Randall Kallinen said the display falls under free expression.
“The mere fact that somebody interprets it one way does not necessarily mean the way the courts will take it. They will side with Mr. Rodriguez that this is an expression of freedom of speech,” said Kallinen.
Kallinen said the display falls under free speech, and Rodriguez has the right to do so legally.
“Hanging even individually named people in effigy is protected freedom of speech,” said Kallinen.
Rodriguez said this is not the first time he has displayed Halloween decoration that has grabbed attention, and he has been planning the current one for months. He said his plan was not to keep it up for long, only until the Halloween season ends.
