According to the Delaware County Courts, a Muncie Police officer took a report Sunday morning regarding a person who was too intoxicated to get home.
The man, later identified as Mikal Rodriguez, was walking down the street when two individuals offered to provide him a ride home. According to the police report, Rodriguez had slurred speech and provided the drivers with two addresses that were not his home address.
The driver decided to take him to Muncie City Hall, where they then waited to speak with an officer regarding safe transportation for Rodriguez. Once the driver exited the vehicle, the passenger remained in the back seat.
While they waited, Rodriguez reportedly touched the passenger’s waist and shoulders.
“Now that your friends are in there, I could rape you,” Rodriguez allegedly told the victim.
He then grabbed the victim’s breasts and continued to touch them after the victim told him to stop.
The officer then came back to the vehicle with the driver and attempted to help Rodriguez out of the car. He allegedly admitted to drinking too much at a house party where the vehicle had picked him up.
Once Rodriguez was taken into custody for public intoxication, the victim gave the officer a statement on what had occurred while they waited in the parking lot.
Rodriguez was preliminarily charged with:
