Docs: Anderson man arrested after soliciting adult posing as teen for sex

ANDERSON, Ind. — An Anderson man was arrested after police say he met with someone he thought was a 14-year-old for sex, but was actually an adult woman.

According to court documents recently filed in Madison County, 34-year-old Nicholas Garcia was charged with one count of child solicitation, a Level 4 felony.

On Tuesday evening, officers were dispatched to a restaurant near the intersection of 29th Street and Main Street on a report of a “possible child soliciter.”

When officers arrived, they spoke with a woman who was reportedly “portraying a 14-year-old” on a mobile application. The woman, posing as the teen, was speaking with a man on the application later identified as Garcia.

Through a weeks-long text exchange, Garcia reportedly asked to meet up with the apparent teen on several occasions and asked for nude photos. During one particular exchange, Garcia reportedly texted the teen that age did not matter to him.

After texting the teen that he wanted to “f— tonight,” Garcia and the teen set up a meeting at a restaurant on Tuesday. When Garcia reportedly arrived at the restaurant, the woman who was posing as the teen was at the location.

During the interaction, Garcia reportedly admitted to her that he was there to meet the teen and sleep with her. The court documents allege that the conversation was recorded by a third party.

Garcia was taken into custody by the Anderson Police Department. During an interview, Garcia reportedly admitted that he was talking to the teen through the mobile application.

According to the court documents, Garcia reportedly stated he talked about sexual encounters with the apparent teen “just to see her response and to see if she was a real person.” When he was met by the adult woman at the restaurant, Garcia told officers he “realized he made a mistake and would never do it again.”

According to court documents, Garcia’s initial hearing occurred on Wednesday afternoon in Madison County court.
