Former Minnesota Senator Nicole Mitchell will no longer be sentenced next week on her burglary conviction after her request that it be pushed back.
This week, Mitchell and her legal team asked the court to delay her Sept. 10 sentencing hearing, saying her attorney “has an illness that precludes him from adequately preparing” for the hearing.
The filing doesn’t go into more detail but asks for a “short continuance” to allow the lawyer to recover.
Prosecutors opposed the motion, noting Mitchell has multiple other attorneys on her legal team who could stand in for her on Wednesday. The defense, meanwhile, said Mitchell is entitled to the legal representation of her choosing.
On Friday, the judge granted Mitchell’s motion, rescheduling her sentencing for Sept. 23. Mitchell remains free until then.

A jury found Mitchell guilty on counts of first-degree burglary and possession of burglary tools back in July following a weeklong trial for breaking into her estranged stepmother’s Detroit Lakes home. She resigned from the Minnesota Senate a week later.

Mitchell faces up to 20 years in prison for the first-degree burglary conviction, but given her lack of prior criminal history, she is likely to receive a far lighter sentence.
