Nonprofit sues city of Edina over tree ordinance
A Minnesota trade association is suing the City of Edina over a tree ordinance the group says violates Minnesota law.
Housing First Minnesota filed the lawsuit on Monday.
Currently, Edina requires property owners to submit tree protection plans and either replant or pay fees when a tree is removed for construction. Housing First says that fee is illegal since it hasn’t been authorized by the Minnesota Legislature.
The organization says it first contacted the city about the ordinance last fall but is taking this step now because the city hasn’t made any changes.
5 EYEWITNESS NEWS reached out to city officials for comment but was told the city doesn’t comment on pending litigation.
