In 2023, a Franklin Circuit Court Judge issued an order on House Bill 9, which would have created a public funding stream for charter schools in Kentucky, arguing the bill was unconstitutional.
Attorney General Russell Coleman asked the court to hear an appeal on the ruling.
Charter schools have been legal in Kentucky since 2017, but none have opened due to a lack of funding.
Oral arguments will begin on September 11.
