The injunction was filed by the Co-Founder of HOPE, Ed Klein, at around 3 p.m. The injunction questions whether the Stephenson County Board has the authority to sell the nursing home without holding a public referendum.
“The public has been asking for a referendum for many years,” said Ed Klein. “One board member even claimed the finances were too complex for voters to understand. But that’s exactly why the people should decide. This is our community’s facility—built and maintained with our support—and we should have a say in its future.”
The sale was scheduled for discussion at the full Stephenson County Board meeting at 6:30 p.m.
Klein said selling the home without the Freeport voters’ opinion could result in a complicated legal battle.
“We believe the responsible and democratic path forward is clear: place the question on the ballot and let the people decide if they still want to maintain a public nursing home in Stephenson County,” Klein stated.
Walnut Acres was voted to be built in 1970.
