South Carolina is the 33rd state to pass hands-free law
COLUMBIA, S.C. (WSPA) – South Carolina is now the 33rd state in the country that has passed a Hands-Free Law.

The new law bans handheld phone use while driving. Governor Henry McMaster held a ceremonial signing today for the bill that has been debated in the State General Assembly for years before passing this session.

“Distracted driving has claimed far too many lives and caused countless collisions across our state. By signing this bill, we will significantly reduce preventable accidents and help ensure more South Carolinians make it home safely to their loved ones,” said Governor Henry McMaster.

The law will officially take effect on September 1 2025, but Law Enforcement and the Department of Public Safety will begin with a 180-day warning period at that time. During the warning period, drivers will be given warnings instead of fines to allow time for people to learn and adjust to the new law.

On February 28, full enforcement will kick in. The first offense will result in a $100 fine. For the second, a $200 fine and two points off your license. This penalty will continue with more offenses within three years.

Dale Willenberg’s family attended the bill signing. Willenberg was a cyclist who was struck and killed by a distracted driver in 2017. His wife, daughter, and grandson were also in attendance.

“I don’t want anyone else to suffer the trauma we have suffered…. Since that fateful day in 2017, Dale’s story will not be repeated. Our roads will be governed by responsibility, awareness, and respect,” said Kelly Willenberg, Dale’s wife.

The Department of Public Safety plans to launch an awareness campaign using road signs and public messaging.
