LOGAN, Utah (ABC4) — A 46-year-old father and his 21-year-old daughter were taken into custody, accused of sexually assaulting a teenage victim and her boyfriend on New Year’s Eve.

Billy Wayne Smith was booked on two counts of first-degree felony forcible sodomy and one count of first-degree felony object rape. His daughter, identified as Autumn Christina Eley, was booked on one count of first-degree felony forcible sodomy.

According to court records, the two alleged victims had gone to a studio apartment shared by Smith and Eley in Logan. Both alleged victims told investigators separately that Smith and Eley had provided them with alcohol before going to the bathroom and allegedly smoking meth together.

The alleged victims said the four then walked to a nearby convenience store where they purchased sodas, cigarettes, and more alcohol. During the walk, Smith allegedly spoke with the two teens, inviting them to engage in sexual activity with him and his daughter, which they both reportedly denied. Smith then allegedly continued to talk about sexual things during the walk, according to a police affidavit.

Smith allegedly took the teenage girl into the apartment’s bathroom, where she said he sexually assaulted her. Meanwhile, Eley began sexually assaulting the teenage boy in the living room. The assault only stopped after the boy said he needed to go to the bathroom. The two reportedly left the apartment shortly after, and the teenage girl went to a hospital for examination.

Both Smith and Eley denied the allegations made by the two teens in separate interviews with investigators. Both said they refused to give the teens alcohol despite their requests due to their ages. The two said they did, however, give the minors apple juice mixed with cinnamon.

Smith and Eley said the four of them never walked to the convenience store, and nothing sexual happened throughout the night.

In July, months after the alleged assault, investigators received DNA testing results that allegedly matched Smith’s DNA to the DNA collected from the teenage girl the night of the alleged sexual assault.

Eley was safely taken into custody on July 18, and she was booked on the aforementioned charge. Smith, meanwhile, turned himself in to police custody on July 28, after returning to Utah from a business trip.

Smith is allegedly on the Sex Offender Registry and has been for “several years,” according to court documents. Both he and his daughter have been ordered to be held without bail, pending a pretrial hearing.

Charges are allegations only. All arrested persons are presumed innocent unless and until proven guilty beyond a reasonable doubt.
