The suspension resulted from a review of sworn statements submitted by the Charlotte-Mecklenburg Police Department and North Carolina Alcohol Law Enforcement. The summary suspension is immediate and is in effect until the case is heard by the Office of Administrative Hearings.
Since July 22, 2023, CMPD officers have responded to 28 calls for service on the premises, including one homicide, three robberies, three aggravated assaults, five assaults, and two weapon law violations.
Mi Cabana’s manager admitted to law enforcement on at least two occasions that she is aware of the law, yet she consistently sells alcoholic beverages to customers after 2 a.m., because she “makes more money selling after hours.”
According to the report, because of the volume of violent criminal activity at the establishment, CMPD officers cannot respond to Mi Cabana without a backup officer.
The permittee’s operation of Mi Cabana has been, and continues to be, a strain on local law enforcement resources, as well as those of first responders and other regulatory authorities. The permittee’s operation of Mi Cabana puts its patrons, staff, first responders, and the general public, at undue risk.
Mi Cabana, at 200 Eastway Drive, has held ABC permits since December 2016.
This is the second summary suspension issued by the NC ABC Commission this year.
