
MOREHEAD, Ky. (FOX 56) — An arrest citation detailed the chilling moments before a 15-year-old was fatally shot early Sunday in Morehead.
FOX 56 previously reported that around 2:30 a.m. on July 20, the Morehead Police Department announced that two minors were shot near an apartment complex on West Sun Street. Gildardo Martinez, 36, was arrested in connection with the shooting Sunday afternoon.
According to the citation, the police were called around 4:18 a.m. to the apartment where 15-year-old Luis Jocsan Nanez Lopez was found dead in the home.
Further investigation showed that there were three bullet holes in the door leading to the room Luis was in, including a wound near his left cheek.

Luis was declared dead at the scene. The other, identified in the citation as Naomi Agrical Nunez, was taken to St. Claire Regional Medical Center.
FOX 56 previously reported that Naomi was later taken to the University of Kentucky Hospital for further treatment.
Around 9:20 a.m. on Sunday, Morehead police interviewed Naomi and Luis’ mother, Aleida Lopez, the citation noted. Lopez said she got off work around 11:30 p.m. on Saturday and found Martinez, her boyfriend, sitting in his vehicle with a friend at a nearby bar.
In the interview, the police said Lopez told Martinez she was heading to the apartment they shared to make dinner for her and the kids. He told Lopez he was going to stay for another 30 minutes.
After dinner, Lopez told the police she went and lay down with her youngest son, whom she shared with Martinez. When he came home, Lopez said he woke her up wanting to have sex, but she turned him down.
It was then that the police noted he became angry and bit her on her left hand and right armpit above her breast before twisting her right arm, causing her to scream.
Lopez recounted that Luis opened the door and told Martinez, who was lying on top of her while he was naked, to stop. After he refused, Luis asked his mother if she would like him to call the police.
She told the police that she had said no to Luis and that they would discuss it further in the morning. Luis then shut the door, and Martinez proceeded to get dressed.
Lopez said Martinez told her he was going to take their son, then grabbed a suitcase and asked if she wanted him to leave. After saying yes, Lopez said she heard a rack pull back and saw Martinez had a black pistol in his hand. She said that he allegedly fired it three times through the door Luis had closed.
In the citation, the police noted that Lopez then grabbed her 1-year-old son and ran out of the apartment before realizing her 3-year-old was still inside. After running back inside, she yelled for Naomi to run.

Several more gunshots were heard, according to the citation, before Martinez appeared outside and ran.
After his arrest, Martinez was charged with:
- Murder
- First-degree assault
- First-degree attempted rape
In a statement, Rowan County school leaders mourned the loss of Luis.
“Jocsan would have been starting his Sophomore year at Rowan County Senior High School,” officials said in a social media post.
In an announcement on social media, leaders called Luis a “sweet student” who did his best each day.
“Even though it is summertime, if a student or adult needs any assistance, our office is open each day from 8:00 to 3:00 this week where you can reach out,” RCHS officials wrote.
Both the MPD and the Rowan County Coroner’s office stated that the shooting investigation remains ongoing, and more information will be released as it becomes available.
