DA: ‘Underage driver’ sentenced in deadly DUI crash in Fresno

FRESNO, Calif. (KSEE/KGPE) – A 23-year-old woman was sentenced on Tuesday in connection with a DUI crash while she was underage that also killed one person in Fresno back in 2021, the Fresno County District Attorney’s Office said.

Malakeh Ghaleb Jaber, who is 23 years old now, was sentenced to 10 years and four months in state prison for gross vehicular manslaughter while intoxicated and driving under the influence with a blood alcohol concentration (BAC) over 0.08%, causing great bodily injury.

Court documents reveal that on Aug. 7, 2021, at around 11:30 p.m., Jaber, who was 19 years old at the time, was driving southbound on Chestnut Avenue at a high rate of speed approaching Herndon Avenue in Fresno. She had four passengers, including 22-year-old Andre Aguilar and three others aged 20 to 21.

At the time, Jaber struck a light pole after failing to navigate a curve on the roadway, causing the vehicle to roll. All passengers, except her, were ejected and sustained serious injuries.

Aguilar later died at the hospital.

Officers with the Fresno Police Department reported observing signs of alcohol impairment and recovered a fake ID belonging to her in the gutter next to the overturned vehicle. Initially, Jaber said she had not consumed alcohol, citing religious beliefs. However, testing later confirmed she had a BAC above 0.08%, the legal limit for a person over 21 years old.

The DA’s office reports a follow-up investigation revealed photos and videos of Jaber drinking earlier that night, an hour before the crash. Additionally, vehicle data later extracted also showed she had been driving approximately 94 mph in a 35 mph zone at the time of the crash.

Jaber and the three passengers were at a birthday party for a relative of one of the passengers before picking up Aguilar to head to another gathering. Just blocks from Aguilar’s home, the DA’s office says Jaber accelerated to 94 mph and crashed the car.

There is no indication that Aguilar knew she had been drinking prior to accepting the ride.

The other passengers also suffered extensive injuries, with one of them suffering from brain injuries and another one suffering scalp lacerations and ankle trauma. Another passenger suffered from severe leg fractures requiring surgery and resulting in probable lifelong disability.

Jaber pleaded guilty on May 28.
