PA Supreme Court votes to allow DNA testing for 1993 Erie murder

ERIE, Pa. (WJET) — The Pennsylvania Supreme Court has ordered DNA testing for Willie James Hardy, the man convicted of murdering his ex-girlfriend Deborah Will in Erie decades ago.

In a 4-3 decision, the court ruled to allow Hardy to pursue post-conviction DNA testing.

The 67-year-old, who is serving a life sentence, claims the results of the testing could prove his innocence.

The case will return to Erie County Common Pleas Court to define the scope of DNA testing, which may include twine, fingernail scrapings, and items from the victim’s purse.

Hardy was convicted of first-degree murder in the strangulation death of Will, who was found dead in her car at the Erisco Industries wire factory in 1993.

The Supreme Court’s decision opens the possibility for new evidence to be considered, potentially impacting Hardy’s conviction.
