PORTLAND, Ore. (KOIN) — The security guard who shot and killed a man last month near a Portland preschool will not face charges, the Multnomah County District Attorney’s Office announced on Tuesday.
Officials say that Manuel Garza “violently attacked” uniformed security guard Eric Salisbury with The Gan Portland Jewish Preschool in the parking lot of the Fanno Creek Medical Center. Portland police investigators say Salisbury’s actions were in self-defense and were justified. Garza died weeks after the incident on May 23.
According to the DA’s office, on May 8 just before noon, Garza drove through the parking lot of the preschool at an unsafe speed, almost hitting Salisbury.
In his vehicle, Salisbury followed Garza to the medical clinic, which is when the altercation took place.
Video of the incident shows Salisbury exiting his vehicle to approach Garza’s car. But Garza exits his car and begins to walk towards Salisbury.
Garza can be heard yelling at Salisbury “What’s your f—–g problem” before Salisbury put his hands on Garza’s throat.
The two men then wrestled to the ground with Garza pinning Salisbury on the pavement and laying on top of him.
Salisbury told Garza that he would shoot Garza, and Garza responded by screaming, “Shoot me” multiple times. Garza then said to Salisbury “You’re powerless b—h.”
When Salisbury grabbed his gun, Garza said to him “You won’t f—— do it,” before Salisbury shot a single bullet into Garza’s stomach. Salisbury then attempted to seek out medical aid for Garza.
“Under these circumstances, it was objectively reasonable for Salisbury to believe Garza was about to kill him, or at least that a felony involving the use of physical force was about to occur. Salisbury had no lesser degree of force available to him to stop the threat Garza presented, due to the fact that Garza had Salisbury pinned on his back,” officials said.
