Suspect in Caleb Quick’s homicide denies allegations, attorney says

FRESNO, Calif. (KSEE/KGPE) – The 16-year-old boy accused of killing Caleb Quick in April was back in court Wednesday.

He is charged with Personal and Intentional Discharge of a Firearm Causing Death and Murder Committed by Lying in Wait.

“At this point, we’ve denied all the allegations, which in juvenile court is the equivalent of a not guilty plea,” Defense Attorney Mark Coleman said.

The suspect was called in for a detention hearing Wednesday to learn whether the judge would let him live at home with his family throughout the rest of his hearings.

“All of the factors for release point towards release in this case, no prior criminal history, youthfulness, good parents, all of that points towards release,” Coleman said.

Coleman says his client does not have a criminal history and would not be a threat to the public.

While he denies the murder allegations, he says that if his client had killed Quick, it would have only been as a reaction to Quick’s alleged misconduct.

“I believe that the alleged offense has to be put into context,” Coleman said. “In other words, it didn’t just happen because there was beef over a hamburger or money owed.”

The judge ultimately decided to keep the teenager in custody, saying the crime took “serious planning.”

“Obviously, the offense is serious. We’re taking it seriously, but, you know, his background is really a good background. He comes from a good family,” Coleman said.

The other suspect, a 16-year-old girl, is still awaiting her detention hearing on June 18.

The Fresno County District Attorney’s Office recommends that both suspects be tried as adults.

The judge will make that decision at an upcoming transfer hearing.

“Our client is 16 years old. If this had occurred when he was 15 years old, he would not be able to be transferred,” Defense Attorney Kathy Bird said.

The defense team says all of their energy and preparation will go toward preparing for that transfer hearing, which they expect to take place in the next few months.

However, before that transfer hearing, they will have a settlement conference on July 8.
