Marquette is charged with murder in the shooting death of 39-year-old Perkins in September 2023 during a botched vehicle repossession.
On April 2, Judge Charles Elliot said Marquette failed to prove that he acted in self-defense following an immunity hearing that lasted over a day.
In a motion filed Friday, Marquette’s attorneys said they intend to appeal that decision and do not expect the Court of Criminal Appeals to rule by the June trial date.
The defense also said multiple scheduling conflicts would render an attorney of the Defense team, its investigator, and an out-of-state expert witness unavailable the week of the trial.
