Steven Bixby was sentenced to death row for the murder of the officers regarding a land dispute at his family’s home in Abbeville County in December 2003.
Bixby was scheduled to be put to death in May, but the court postponed a potential sixth execution and decided that a judge first needs to determine if he is mentally competent.
Bixby’s attorneys have argued that he is mentally unstable to understand the evidence against him. A psychologist also mentioned that Bixby understands what led to his death sentence, but that he also thinks blood found on his clothes the night of the killings contains Jesus Christ’s DNA.
The South Carolina Supreme Court voted three to two to halt the execution.
The Justices shared that they would prefer a circuit judge determine if Bixby is competent.
That hearing is required to happen by September.
