Hoffman execution postponed on constitutional grounds

NEW ORLEANS (WGNO) — In a developing story, the execution is postponed for an inmate on Louisiana’s death row due to an appeal of the method of that planned execution, nitrogen gas.

A federal judge has agreed to block the state’s first use of that method.

Inmate Jessie Hoffman’s lawyers say it constitutes cruel and unusual punishment, violating the Eighth Amendment.

There are conflicting reports of how quickly the gas works, and the level of suffering involved. The state attorney general is appealing the postponement to the 5th Circuit Court of Appeals.

Hoffman is on death row for kidnapping, raping and killing a New Orleans woman in 1996.
