On Feb. 9, 2022, officers responded to Javon Bea Hospital for reports of a sexual assault by a victim. A toxicology report for the victim came back positive for benzodiazepine, which is an active ingredient in Xanax and Valium.
The woman said she does not take any prescriptions related to benzodiazepine.
The victim told authorities she did not consent to any sexual activity with Bieniek.
Bieniek’s DNA was found on the woman’s socks, according to Illinois State Police lab reports.
The woman was granted an order of protection against the suspect after the incident in 2022 that expired in 2024.
Bieniek is charged with criminal sexual assault without consent.
He was booked into the Winnebago County Jail on March 11th.
