According to court documents filed in Marion County last month, Dustin Harvey was charged with one count of failure to remain at the scene of an accident resulting in death, a Level 4 felony.
On July 12, 31-year-old Ivan Angel Castro was pronounced dead after a crash in the 5200 block of Massachusetts Avenue. Officials with the Indianapolis Metropolitan Police Department said at the time that the other driver involved in the crash, who police allege is Harvey, fled the scene after the crash.
During an investigation, IMPD officers said that a 2012 Nissan Juke driven by Castro was traveling northeast-bound on Massachusetts Avenue. A Chrysler was traveling northbound on East 30th Street and was stopped at the Massachusetts Avenue intersection.
The documents said the Chrysler started to turn left onto Massachusetts Avenue and turned into the passenger side of the Nissan. This caused the Nissan to flip several sides. As the vehicle flipped, Castro was ejected from the car because he was not wearing a seatbelt.
After the accident, the documents said the Chrysler “stopped for a minute and then fled the scene.” The Chrysler was seen on video going southwest bound on Massachusetts Avenue with no front bumper.
Police on the scene used the front bumper and the vehicle’s VIN information to track down the person who the car was registered under — a family member of Harvey’s. The documents said that a confidential informant later told police that “Dutty,” later identified as Harvey, reportedly borrowed the vehicle and was the driver when the crash occurred.
The documents said that Harvey was tracked down through his place of employment. Through cell phone records obtained by police, the documents also said that Harvey’s cell phone was in the area of the crash site at the time of the incident.
The Chrysler was later located at a tow shop. The documents said that the vehicle had front-end damage on the passenger side and that the bumper was missing.
According to court documents, Harvey’s initial hearing is scheduled for Wednesday morning.
